No. <br /> ANALYSIS; <br /> #4911 Rezone will provide zoning compliance for the property and will not <br /> change the permitted use of the property. <br /> CONCERNS EXPRESSED AT/AFTER PUBLIC HEARING; <br /> STAFF COMMENTS: <br /> R.P.C. - Petition 4911 . This proposed rezoning Is to resolve past and existing <br /> violations where commercial buildings have been constructed In areas <br /> zoned for residential use, or where they were constructed with <br /> insufficient setback or side yards. Some of these and other violations <br /> are also pending before the County Board of Adjustment and some are <br /> before the Corporation Counsel for prosecution. The extension of the <br /> C-2 area to the west also violates a previous agreement with the Town of <br /> Medina to not encroach further toward the cemetery which Is adjacent to <br /> the RH-/ parcel to the west. <br /> A detailed site plan has been submitted which shows the location of <br /> buildings and the necessary zoning changes due to this construction. <br /> The site plan does not show additional commercial development , only the <br /> current correction of violations. <br /> The applicant needs to be cautioned that any future violation may result <br /> In orders to remove any buildings constructed In violation of the zoning <br /> ordinance. <br /> E.H.D. — Petition 4911 No objection to this petition. <br /> Co.
