It contained the price, <br /> terms , and conditions we , as sellers , would accept when <br /> included in a formal offer from you. You will also recall <br /> your offer of April 30 , 1990 had a number of omissions <br /> and/or mistakes . Consequently, hand-lettered changes/ <br /> corrections were written into the offer by us and subse- <br /> quently approved by you. The final offer was presented by <br /> you and accepted by us on May 1, 1990 . <br /> In real estate sales transactions , the Offer to Purchase is a <br /> very important document. Closing documents are based on the <br /> contents of an accepted offer. Your offer granted nonre- <br /> strictive easement rights in favor of Lot 1 CSM 5295 . <br /> This information found its way to the warranty deed and <br /> title insurance policy. My wife was ill and was not avail- <br /> able to "sit in" when we accepted your offer. Actually, <br /> the four of us met for the first time as a buyers/sellers <br /> group at the closing. On this occasion, easement rights were <br /> not discussed. If they had been and had we agreed to ot'--" <br /> than nonrestrictive rights , the agreement would have bee <br /> included in the offer to purchase as an addendum to the <br /> offer. Your attorney would have insisted upon it. <br /> Ref : Additonal easement rights : Since our plan, when <br /> implemented, will not have an adverse effect on your property <br /> (Lot 2 CSM 5295 ) , additional rights , if in fact you have <br /> any to grant, will not be needed.
