ZONING ORDINANCE AMENDMENT NO. 4928 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> MAZOMANIE, ROXBURY <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Towns of Mazomanie and Roxbury be amended to <br /> include in the non-wetland District the following described land: <br /> Part of the SE 1/4 SE 1/4 Section 18 and NE 1/4 SE 1/4 Section 13, Towns of <br /> Mazoman e and R xb r <br /> Commencing at the Southeast corner of said Section 13; thence N 000 01' 13" <br /> East along the East line of the SE 1/4 of said Section 13, 1603.23 feet to the <br /> Westerly right-of-way line of STH 78 and the point of beginning. Thence N 25° <br /> 43' 36" East along said right-of-way line, 420.56 feet; thence N 74° 51' 24" <br /> West, 554.91 feet to the Easterly line of the State of Wisconsin Railroad; <br /> thence S 32° 46' 20" West along said Easterly line, 1207.25 feet; thence S 75° <br /> 34' 12" East, 813.74 feet to said Westerly right-of-way line of STH 78; thence <br /> N 20° 39' 57' East along said Westerly right-of-way line, 488.05 feet; thence N <br /> 03° 09' 52" East along said right-of-way line 159.95 feet; thence N 25° 43' 36" <br /> East, 86.23 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> 1. The project design specifications including filling, wetland restoration <br /> and water quality safeguards shall be implemented and maintained as <br /> specified in the plan submitted by T. J. Ramaker & Associates and James <br /> H. Zimmerman dated 9/16/91. <br /> 2. This amendment shall not take effect until more than 30 days have <br /> elapsed since written notice of the County Board's approval of this <br /> amendment was mailed to the Department of Natural Resources. During <br /> that 30-day period the Department of Natural Resources may notify the <br /> County Board that it will adopt a superseding shoreland ordinance for <br /> the County under Section 59.971(6) of the Wisconsin Statutes. If the <br /> Department does so notify the County Board, the effect of this amendment <br /> shall be stayed until until the Section 59.971(6) adoption procedure is <br /> completed or otherwise terminated. <br /> EFFECTIVE: <br />
