Proposed Re-Zoning
<br /> Our offer to purchase the property at 9439 Highway Y, Town of
<br /> Roxbury, from Tom and Josie Tarnutzer, has been accepted. We
<br /> would like to request a re-zoning of the property, currently
<br /> zoned RH-3, to a conditional use under A-2. minimum of 8 acres,
<br /> pursuant to Sec. 10-126(5) (a) , County Code of Ordinances. The
<br /> conditional use would be for operation of a limited family
<br /> business, pursuant to Sec. 10. 192, County Code of Ordinances.

<br /> We currently operate a small health care consulting business in
<br /> Madison, and would like to move the office into the house at 9439
<br /> Highway Y. We are a service oriented business, who travel to our
<br /> clients' place of business most of the time . Our clients include
<br /> primarily hospitals, nursing homes, physicians, and other health
<br /> care providers . Employees include ourselves plus one fulltime
<br /> administrative assistant/clerical support person.
<br /> On October 15, 1990, we met with the Roxbury Town Board, to
<br /> explain our request . The current owners, Tom and Josie
<br /> Tarnutzer, also appeared with us in support of the proposed re-
<br /> zoning. They presented the Board a petition signed by the
<br /> neighbors expressing their support of the request . Board members
<br /> indicated probable support of the request, if assurances were
<br /> provided that the property would not be sub-divided . The primary
<br /> concern seemed to be concern that a housing sub-division might be
<br /> developed. We explained that was contrary to our purpose for
<br /> buying the land in the first place , and would not have any
<br /> problem with such a restriction.
<br /> One Board member suggested including a deed restriction. Upon
<br /> discussion with Mr. Bill Fleck, of the County Zoning Office , he
<br /> suggested the re-zoning "A-2, minimum of 8 acres, " under Sec. 10-
<br /> 126(5) (a) , County Code of Ordinances . Mr . Fleck said this zoning
<br /> classification would provide the Board the assurances it sought
<br /> to prohibit any further development of the property under the
<br /> proposed re-zoning.
<br /> We , John Keefe and Sandra Hayes, a married couple , are acting as
<br /> agents for the current owners, with the understanding that we
<br /> will become the a.plicants upon closing on the property,
