The Plan <br /> Commission found that the site could easily become an attractive nuisance,and found that <br /> management of the site as proposed would be detrimental to public health,safety and welfare. <br /> 2. That the uses,values and enjoyment of other property in the neighborhood for purposes already <br /> permitted shall be in no foreseeable manner substantially impaired or diminished by establishment, <br /> maintenance or operation of the conditional use. FINDING: NOT SATISFIED,for the following reasons: <br /> a. A resident adjacent to the proposed site explained that he had cultivated trees for many years as <br /> a cash crop,described stormwater patterns and indicated that the additional drainage from the <br /> proposed sand pit would increase water to his land and cause harm to his trees. The applicant <br /> presented no stormwater drainage plan to defeat the resident's assertion. The Plan Commission <br /> concluded that storm water runoff could foreseeably harm the value of the trees as a cash crop. <br /> b. As set forth in#1 above,without fencing or some type of enclosure or an on-site caretaker,the <br /> site could become an attractive nuisance thereby diminishing public safety and adversely <br /> affecting adjacent properties. <br /> C. As set forth in#1 above,increased traffic and lack of direct access to STH 12-18 would <br /> foreseeably diminish use,value and enjoyment of adjacent properties who must also use the <br /> county road to access STH 12-18. <br /> d.
