Moody and Sasso: <br /> The following sets forth she agreement of the parties signing <br /> and counter-signing this letter agreement with regard to <br /> certain specific issues regarding the design, construction, <br /> and operation of proposed project to be constructed at 3321 <br /> Commercial Avenue and 3324 Furey Avenue. The terms of this <br /> letter agreement are conditional upon ultimate rezoning <br /> approval of 3324 Furey Avenue by the Dane County Board of <br /> Supervisors and the absence of a veto by the Town of Blooming <br /> Grove, pursuant to Wis. Stats. s. 59.97. <br /> The parties agree: <br /> 1. To the •extent permissible under applicable law the <br /> project in question will be issued a single building permit <br /> for the total project. The parties acknowledge that the <br /> project will be constructed in phases. <br /> 2. The plans, specifications and the constructed <br /> , improvements shall include: the installation of security <br /> lighting on the site and a brick facade on the portion of the <br /> building directly adjacent to Furey Avenue. <br /> 3. The Furey Avenue ingress egress will be equipped with <br /> a gate which will be closed after 7:00 p.m. <br /> 4. Trash pick-up will be scheduled to occur after 6:00 <br /> a.m. and before 7:00 p.m. <br /> 5. The air quality equipment to be installed on-site <br /> will be CWN down draft spray booth. The booth is in compliance <br /> with EPL standards and exceeds NFPA codes 33 & 34 and CWN paint <br /> preparation stations. <br />
