ZONING ORDINANCE AMENDMENT NO. 4494 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> BLOOMING GROVE <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Blooming Grove be amended to include in <br /> the C-2 Commercial District the following described land: <br /> Pet. #4494: <br /> Part of the NW 1/4 NE 1/4 of Section 5, Town of Blooming Grove described as <br /> follows: Lots 86 and 87 Block 15 of the Replat of the Second Addition to E.L. <br /> Gallagher Plat. <br /> This amendment will be effective, if within 90 days of its adoption by the <br /> County Board of Supervisors, the owner or owners of the land shall record the <br /> following restrictions on said land running in favor of Dane County and the <br /> pertinent Town Board as well as the owners of the land: <br /> A. Use shall be limited to vehicle refurbishing and repair and <br /> related parts sales. <br /> Conditions on this rezoning as authorized under § 10.255(3) Dane County Code <br /> of Ordinances are imposed as follows: <br /> 1. The plans, specifications and the constructed improvements shall <br /> include: the installation of security lighting on the site and a <br /> brick facade on the portion of the building directly adjacent to Furey <br /> Avenue. <br /> 2. The Furey Avenue ingress/egress will be equipped with a gate which <br /> will be closed after 7:00p.m. <br /> 3. Trash pick-up will be scheduled to occur after 6:00 a.m. and before <br /> 7:00 p.m. <br /> 4. The air quality equipment to be installed on-site will be CWN down <br /> draft spray booth. The booth is in compliance with EPL standards and <br /> exceeds NFPA codes 33 & 34 and CWN paint preparation stations. <br /> 5. If the landscaping portion of the project is incomplete at the time a <br /> final occupancy permit is requested, Gray Bahl Partnership agrees to <br /> furnish a letter of credit in favor of the Town of Blooming Grove in <br /> an amount not to exceed one hundred twenty-five percent (125%) of the <br /> incomplete portion of the written, accepted bid for the landscaping to <br /> secure completion of that portion of the improvements. <br /> EFFECTIVE: /Z)/( //)72 <br />
