Cheney, Land Surveyor/Professional Engineer/Agent for John Keleny <br /> 6214 North Highlands Ave. <br /> Madison, Wi . 53705 <br /> To: The Town of Middleton <br /> Held & Associates, Consulting Engineers/Agent for the Town of Middleton <br /> Dated this 20th day of July, 1989 Revised August 17, 1989 <br /> Re: EXTRACTION OF BLACK DIRT FROM THE RUSS HODGSON FARM ON VALLEY VIEW ROAD <br /> Dear Mr. Held; <br /> The following conditions for the removal of black dirt by John Keleny are <br /> hereby proposed if the Town Board of the Town of Middleton consents to approve <br /> Mr. Keleny's application for a Conditional Use Permit: <br /> 1 . ) Only 1 Acre of land shall be stripped of black dirt at one time <br /> 2.) After stripping, subgrade will be leveled or back filled and 6 inches <br /> of black dirt will be replaced <br /> 3.) Material tobe used for backfill will be free of wood, metal and other <br /> foreign material and will consist of surplus dirt from excavations at building <br /> sites and projects in the Madison Area, no broken concrete, construction ruble, etc. <br /> 4.) Approximately 3 to 5 acres of land per year will be stripped <br /> 5. ) The balance of the land will be in farm production <br /> 6.) After removing the black dirt, reshaping and replacing a 6 inch layer, <br /> the land will return to farm production, final grade will not be above existing grade. <br /> 7.) Material will be hauled from the site only entering Valley View Road <br /> at or near Russ Hodgson's driveway, and trucks will turn only west. <br /> 8.) Vision from this entrance on to Valley View Road isexcellent in both <br /> directions <br /> 9.) Trucks hauling fill material to the site shall approach the entrance <br /> driveway only from the West <br /> 10. ) Hours of operation shall be from 7.:00A.M. to 7 :00 P.M. <br /> 11 . ) The entrance drive shall have a gate to prevent unauthorized entry <br /> during non-business hours <br /> 12. ) Surface drainage thru the site shall be maintained at all times <br /> 13.) The operation shall be in conformance with the Town Erosion Control Ord- <br /> inance at all times, particularly with regard's to tracking of soil onto <br /> Town Roads <br /> 14.) Mr. Keleny plans to purchase this land if this permit is granted; it is <br /> therefore in his best interest that the land be productive farmland after the <br /> excess black dirt is removed. It is also in his best interest to maintain smodth <br /> or regular grade to best facilitate future farm use <br /> 15. ) Completion of black dirt removal is anticipated to take from 5 to 8 years . <br /> Any further questions concerning this request may be directed to me or Mr. <br /> Keleny.
