EASEMENT AGREEMENT <br /> Ef .i ) 5 <br /> THIS EASEMENT AGREEMENT is made and <br /> entered into this 3rd day of December, 2004 by and <br /> between Julie L. Mahnke and Timothy W. Burns <br /> ("Grantors") and Lane Dohl and Wendy Dohl <br /> ("Grantees"). <br /> WITNESSETH: <br /> WHEREAS, Grantors are the owners of the real <br /> estate shown on the attached Exhibit A ("Easement <br /> Premises") described as: <br /> See attached Legal Description <br /> WHEREAS, Grantees are desirous of obtaining easement rights to the existing <br /> driveway on above described real estate in order to provide access to their property. <br /> NOW, THEREFORE, for and in consideration of the mutual covenants and promises <br /> hereinafter set forth and other good and valuable consideration,the parties agree as follows: <br /> 1. Grant of Easement. Subject to the conditions herein contained, Grantors do hereby <br /> grant to Grantees, as an easement appurtenant to Grantee's Property, a non-exclusive <br /> perpetual easement over and across the Easement Premises for purposes of ingress and <br /> egress from Grantee's property to Bass Lake Road. <br /> 2. Easement Premises. The easement premises shall be the already existing driveway <br /> won GrvIcgpsrace'mi a�Lrpdo Bass Lake Road to the lot line of Grantees' property. Grantors <br /> shale responsible for all cos?' nd expense regarding the maintenance and insurance of the <br /> Easement Premises. <br /> 3. Acknowledgment and Ratification. Grantors and Grantees further acknowledge that <br /> the Easement Premises are essential for driveway purposes and in order to access their <br /> respective property and agree not to in any way interfere with the use of the Easement <br /> Premises by either party or their respective lessees, successors or assigns. <br /> 4. Severability. The provisions hereof shall be deemed to be severable. If any <br /> section, paragraph, clause, provision or item herein shall be held invalid by a court of <br /> competent jurisdiction,the invalidity of such section,paragraph,clause, provision,or item shall <br /> not affect the other provisions of this Agreement. <br /> 5. Notice. All notices, requests and demands shall be in writing and shall be delivered <br /> to or be mailed by certified mail, return receipt requested, as follows: <br /> If to Grantors: Julie L.
