o , ,,,, DANE COUNTY LAKES & WATERSHED
t ,i Richard J. Phelps
County Executive
COMMISSION
`L ' •`'=
` c o N
Lloyd L.Eagan,Coordinator
608/267-0118
DATE: November 1, 1989
TO: Lakes and Watershed Commission Members
FROM: Lloyd Eagan 14G
RE: Notice of Zoning Petition # 4621 by Fuchs, Inc. to
change the zoning from the wetland district to the non-
wetland district.
The application is attached for your reference. The
shaded area indicates the applicant's property. The area to
the east of the floodplain line noted "excluded" was filled
prior to the adoption of Dane County's Shoreland and Wetland
Ordinance and therefore was excluded from it.
According to the official wetland maps this is an S3k
wetland which means it has wet soils and supports shrub
vegetation. It would provide groundwater recharge and
wildlife habitat in addition to flood storage benefits.
In addition to the original fill, the applicant has
placed more fill along the tongue of the "excluded" area so
that the filled area presently extends all the way to the
railroad tracks. This fill was placed without a permit from
the County or the U.S. Army Corps of Engineers, so this is an
after the fact permit application. Apparently the applicant
desires to fill the entire width of the property. The
proposed use is truck parking.
The U. S. Army Corps of Engineers is sending someone to
look at the site next week. At this point, it appears the
DNR will recommend denial of the rezoning request, whether
removal of the unpermitted fill will be recommended is not
clear at this time. The zoning hearing on this is scheduled
for November 14 , 1989 . If the Commission votes to submit
comments on the proposed action, I will be happy to forward
them to Bill Fleck before the zoning hearing.
CC: Bill Fleck - ZA
Clark Ammundson - DNR -Madison Area
Jeanie Sieling
Bill Lane - RPC
NOV 07 1989
210 Martin Luther King,Jr.Boulevard,City-County Building,Madison,Wisconsin 53709 608/266-4114 TDD/266-9138
