Dane County Department of <br /> Zoning <br /> December 4, 1989 <br /> Page 2 <br /> 3) Reason for the proposed building, addition, alteration, <br /> etc. : <br /> There are no plans to build, add or alter the Colonial Heights <br /> Apartments. The apartment complex will remain as it currently is <br /> for the foreseeable future. The reason why the owner is applying <br /> for a Conditional Use Permit is explained in paragraph (4) below. <br /> 4) Reasons explaining hardship: <br /> The Colonial Heights Apartments were built during the 1960's <br /> in a C-1 commercial district. Multi-family apartments were a <br /> permitted use in the C-1 district at that time. <br /> Since that time, the Dane County Zoning Ordinances have been <br /> amended to their current state which permits multi-family <br /> apartments in a C-1 district by Conditional Use Permit only. <br /> Accordingly, since the date of the amendments, the Colonial Heights <br /> has been a legal nonconforming use. <br /> The reason for this CUP application is not any proposed <br /> addition, alteration or rebuilding. Mr. Grandlich is refinancing <br /> an existing mortgage on the property and the lender has requested <br /> that the owner apply for a Conditional Use Permit so that the use <br /> of the property will be a legal, conforming use. <br /> The Dane County Zoning Ordinances impose a hardship upon this <br /> property owner in that they would prevent the rebuilding of the <br /> apartment complex to its current state if a casualty were to occur. <br /> Specifically, §10.23 (3) of the ordinances provides that if a <br /> casualty occurs which destroys in excess of 50% of the assessed <br /> value of the property, the property when rebuilt must be <br /> conforming. The owner, and the lender, would like the option of <br /> rebuilding the apartment complex to a condition identical to that <br /> existing at the current time if such a casualty occurs. <br /> Given the location of the complex, it is impossible to acquire <br /> sufficient adjoining land to meet all side yard, parking and other <br /> requirements. <br /> Though the Colonial Heights Apartments are over 20 years old, <br /> they are in remarkably good condition and have been maintained in <br /> such good condition because of the conscientious efforts of its <br /> owner, Arthur G. Grandlich. Mr. Grandlich is the developer who <br /> constructed the apartment complex in the 60's, and obviously, such <br /> long term ownership shows a high degree of commitment to the <br /> property. Mr. Grandlich intends to continue to meet his high <br /> standards of maintenance and upkeep. Accordingly, it is felt that <br /> the granting of this Conditional Use Permit will not in any way <br />
