No. <br /> ANALYSIS: <br /> CONCERNS EXPRESSED AT/AFTER PUBLIC HEARING; <br /> STAFF COMMENTS: <br /> R.P.C. - Petition 4679. This Is a vacant commercial building In a farmland <br /> preservation area of the town of York where the county/town objective and <br /> policies are: <br /> "Objective: The objective of the Town of York Is to facilitate <br /> commercial and industrial development which fosters and enhances <br /> the growth of agricultural activities and enterprises within the <br /> Town. <br /> Policies: To accomplish its objective with respect to commercial <br /> and industrial development , the policies of the Town will be: <br /> 1 . To allow such commercial and industrial development as is <br /> needed to support existing agricultural activities where it <br /> will not result in environmental degradation or conflict <br /> with farming operations. <br /> 2. To limit rezoning to that portion of land which is necessary <br /> for the commercial or Industrial use contemplated. <br /> 3. To avoid any substantial expenditure of public funds and the <br /> incurrence of municipal debt for the construction or pro- <br /> vision of municipal improvements and services usually <br /> associated with commercial and industrial development . " <br /> This site was rezoned to C-1 in 1980 to allow fish farming (somewhat <br /> related to agriculture) . Now the question is whether the vacant building <br /> should be used as a body shop. The nearest residential unit Is approx- <br /> imately 1 ,000 feet to the south. If the body shop can be marginally <br /> rationalized as agriculture related, the C-2 zoning should be condition- <br /> al . Most of the C-2 permitted uses would be incompatible at this loca- <br /> tion. <br /> Any rezoning should be specifically limited to vehicle repair to preclude <br /> other more intensive uses. <br /> E.H.D. - Petition 4679 The existing building is served by a holding tank. <br /> The new owner must file a new owner/pumper agreement with this office . <br /> Co.
