Fish, his wife <br /> (the Fishes) . <br /> The Teuberts own real estate (the Teuberts' Parcel) located <br /> in Dane County, Wisconsin and described on attached Exhibit A. <br /> The Fishes own adjoining real estate (The Fishes' Parcel) located <br /> in Dane County, Wisconsin and described on attached Exhibit B. <br /> The Teuberts use their parcel as their personal residence. <br /> The Teuberts' Parcel is currently zoned C-1. The Teuberts have <br /> petitioned to rezone their parcel from C-i to R-2 . <br /> The Fishes' Parcel is used for the production and shipment <br /> of plastic drain tile. The Fishes' Parcel is zoned C-2. <br /> FOR CONSIDERATION, and intending to be legally bound, the <br /> parties agree: <br /> 1. The Fishes shall not object to the rezoning of the <br /> Teuberts' Parcel from C-1 to R-2. <br /> 2. As a covenant running with the land binding upon all <br /> present and future owners, tenants and occupants of the Teuberts' <br /> Parcel, the Teuberts acknowledge and consent to the present <br /> commercial zoning of the Fishes' Parcel and to any commercial use <br /> which now or in the future may be permitted by that commercial <br /> zoning; and agree that the current use of the Fishes' Parcel for <br /> the production and shipment of plastic drain tile does not <br /> constitute a nuisance, and that that current use may continue as <br /> long as the Fishes desire. The Teuberts further agree that they <br /> will not take any action inconsistent with this covenant. <br /> 3. This is an agreement running with the land and is <br /> binding upon and shall inure to the benefit of the parties and <br /> their respective heirs, representatives, successors and assigns. <br /> Dated July , 1988. <br /> Arthur Teubert Jr. Gary A.
