. 1. Concern: B-1 zoning may allow certain activities inconsistent with <br /> Town's Land Use Plan. <br /> , <br /> /�rfr Proposal: Use a deed restriction to permit only those activities <br /> necessary for TBC's operation. <br /> /Orapos a/ <br /> Ceeoxd fit: Reduce B-1 zoning district to include Chalet only for <br /> tavern, wedding receptions, seminars and similar activities. (Concession <br /> on this point made to accommodate wishes of lending agency according to <br /> Jonathan Barry.) However, if County will not reduce B-1 zoning to an area <br /> no greater than 20,000 square feet, deed restriction to be used as stated <br /> above. <br /> 2. Concern: Annoying night lights <br /> Agreement: Outdoor lighting for organized activities in the RE-1 area <br /> exclusive of parking and building lighting, shall be limited to the <br /> downhill ski slopes. All lights, including parking and building lighting <br /> shall be installed, modified or maintained in a manner so as to reasonably <br /> preclude the reflection or glare onto adjoining premises. Any new lighting <br /> systems or replacement of existing lighting systems shall be of the low <br /> pressure sodium variety. <br /> Hours of operation of lighting when the facility is open for recrea- <br /> tional purposes shall be limited to 11:30 p.m. However, lighting may be <br /> continued beyond this hour when the facility is not open to the general <br /> public for any revenue generating activity. <br /> Every effort shall be made to limit lighting when not open to the <br /> general public to only those areas or slopes where maintenance, snowmaking <br /> or other activities are taking place. <br /> 3. Concern: Ski facilities and hill might operate at late hours. <br /> Agreement: Nominal 10:30 closing but agreement allows one additional <br /> hour to permit orderly clearance of slopes and departure of patrons. <br /> Concession made to allow ski teams to use slopes later than 10:30 - up to 6 <br /> times per year with Town Board permission. <br /> • <br /> 4. Concern: CUP for sale of alcohol could result in operation of tavern <br /> unassociated with, organized activities. <br /> Agreement: The sale of alcoholic beverages shall be limited to those <br /> times when organized activites are taking place. , e.g., skiing, wedding rec <br /> eptions , private parties, seminars or when food is served in conjunction <br /> with the restaurant being open. Carry out sale of alcoholic beverages <br /> shall not be permitted. Tavern facilities shall not be advertised as such. <br /> Liquor sales shall not be offered to public when private parties are being <br /> held. <br /> 5. Concern: Excessive noise from all activities. <br /> Agreement: There shall be no installation -of speakers for the amplifi- <br /> cation of sound beyond a distance of 75 feet from the Chalet. <br /> -No intention of transmitting sound to the slopes. <br /> -Sounds if at all required are intended to be confined to the area <br /> within 75 feet from the building. (Concession to allow speakers for music <br /> for wedding receptions. <br /> 6. Concern: Parking on town road (Bohn Road) <br /> Agreement: Mr. Barry stated that adequate parking will be available in <br /> upper and lower parking lots and that they will assist Town in enforcing <br /> parking regulations to keep autos from parking on the Town Road. <br /> 7. Concern: That any road improvement costs be shared by Tyrol Basin <br /> Corp. as required by Vermont's Land Use Plan. <br />
