- 4 - <br /> Local Government Plat Approval Authority <br /> D. A. Yanggen, Land Use Specialist, U.W.-Extension <br /> December, 1985 <br /> I. "Objecting Agencies" and "Local Approving Authorities" <br /> A. An "objecting agency" (state-agencies or some counties) receives a <br /> plat and must certify non-objection to it prior to the time it is <br /> formally considered for approval by an approving authority. Sec. <br /> 236. 12(3). <br /> B. An "approving authority" (cities, villages, towns and counties) <br /> reviews the plat according to its adopted standards and gives <br /> approval only after a plat has been given a non-objection by all <br /> objecting agencies. Sec. 236.12(3). <br /> II. Objecting Agencies and Basis of their Review <br /> III. Approving Authorities and Basis of their Review <br /> A. Approving authorities are local governing bodies or their delegated <br /> planning committee or commission. <br /> B. Which local government must approve depends upon where the <br /> subdivision is located. Sec. 236.10(1) says the approval requires is <br /> as follows: <br /> (a) If within a municipality--the municipality. <br /> (b) If within the extraterritorial plat approval jurisdiction of a <br /> municipality (i.e. , 3 miles of 1st, 2nd or 3rd class city or <br /> 1-1/2 miles of 4th class city or village) (sec. 236.02(5)). <br /> (1) The town board <br /> (2) The governing body of the municipality if it has a <br /> subdivision ordinance or official map adopted under <br /> 66.23(6). <br /> (3) The county planning agency if it has a full-time engineer <br /> or zoning administrator. <br /> (c) If outside the extraterritorial plat jurisdiction. <br /> (1) The town board <br /> (2) The county planning agency <br /> C. Where 3 mile extraterritorial plat approval jurisdiction of two <br /> municipalities crossed each other City A has approval jurisdiction <br /> only over 4 lots actually located within its jurisdiction and <br /> adjacent city had jurisdiction over the remaining 100 lots. <br /> Brookhill Development Ltd. v. City of Waukesha (1981) 307 N.W. 2d <br /> 782, 112 Wis. 2d 27. <br /> D. Subdivision ordinances typically overlap one another. In case of <br /> conflicting standards, the most restrictive requirements govern sec. <br /> 236.13(4). <br />
