-. <br /> To: The Village of Deerfield Planning Committee August 10, 1988 <br /> Dear Committee: <br /> My name is David R. Cheney. I am a land owner in the Village of Deerfield. <br /> I am a Land Surveyor and Registered Professional Engineer practicing in Dane County <br /> for the past 35 years . <br /> I wish to voice my objection to Walter Olson 's two petitions to create eight <br /> residential building lots immediately West of the Village Limits in the Town of <br /> Deerfield . My reasons for objecting are as follows : <br /> As persons active and interested in fostering the orderly <br /> development of the Village of Deerfield , try to anticipate and head off decisions <br /> that will be costly and restrictive to future Village growth. These two petitions <br /> will do both; <br /> If granted, the petitionor will create eight homesites that will have no sewer <br /> and water mains, no concrete curb, no storm sewer, no underground utilities and a <br /> blacktop street far short of the standard specifications of the Village. In the <br /> future, when it would become important, even essential to annex these homes into <br /> the Village in order to maintain orderly growth, these homeowners would refuse to <br /> be annexed in fear of being assessed for these missing improvements. This is one of <br /> the principal reasons for the formation of "Town Islands" . All improvements should <br /> be made to the building lot before it is sold , it then becomes a part of the sale <br /> price of the lot and eventually becomes incorporated into the home mortgage. <br /> Incidently, the City of Madison has so many Town Islands within it's borders <br /> that they have applied for City Status : the City of Wingra ' ' ' ' ' It is important to <br /> remember that an annextion of an area can only happen with the owner's consent, <br /> there is no such thing as forcing someone to annex against his will . <br /> Another point to be made concerni4ig Olson's long range plan to build a street <br /> from Highway #12 to the Bike Path along the route of Jenson Road and Robert Nelson <br /> Road just West of the Village Limits . Unimproved Lots along such a road, remaining <br /> in the Town of Deerfield would represent a barrier to the future expansion of the <br /> Village in that direction. A second , and equally important rule is that only <br /> contiguous lands can be annexed to the Village. <br /> The lands West of the Village represent the most favorable for future Village <br /> growth. Only the lands Northwest, West and Southwest can be served by your present <br /> sewerage system without pumping or lift stations . The lands Southeast, East and <br /> Northeast are mostly drained marshes, unsuitable for economical use. The siting of <br /> your water tower 1pt just off Jenson Road represents an "Educated Guess" by one of <br /> the previous engineers in your employ, as to the center of the next 20 years of <br /> growth. If Mr. Olson 's Plans prevail , I will make and "Educated Guess" that this <br /> water tower site will be outside the Village Limits forever. <br /> In conclusion, let me assure you that petitions for this type of development <br /> in any of the fast-developing communities in Dane County, more experienced with <br /> fast growth, would be soundly rejected . In many cases this rejection with be acc- <br /> ompanyed by the forefieture of a considerable application fee, $1000.00 in one of <br /> these communities. An engineering analysis of petitions such as this can be very <br /> costly to a municipality. I therefore urge you to reject these two Certified <br /> Survey Requests or condition their acceptance on their annexation to the Village <br /> and installation of all public utilities; sewer & water mains & laterals , storm <br /> sewer (if necessary) underground power, telepone and TV, concrete curb and blacktop <br /> street. SUCH A REJECTION OR CONDITIONAL APPROVAL IS CLEARLY PRESENTED TO YOU BY <br /> WISCONSIN STATE STATUTES . <br /> Yours truly <br /> / .t/i��!: , <br /> Iav R.
