CONDITIONS FOR THE <br /> CONDITIONAL USE PERMIT FOR THE REMOVAL <br /> OF CLAY FROM THE ED KAMM PROPERTY <br /> No clay will be removed from the forty acres directly south of April Hill's Subdivision. <br /> The Public Works Department has negotiated a price for hauling clay on "MN" and not <br /> Siggelkow. --- <br /> order=-i.v pay fuL mwtre hem:dins. Wt. are ceri€id Hauling will be on Holscher to "MN", "MN" to "AB", "AB" <br /> to the Landfill. <br /> Instead of hauling clay four different construction seasons, hauling will be limited <br /> to two seasons. The bulk of the material will be hauled in 1989 and the remainder <br /> in 1990, 1991 or 1992. <br /> There will be a gradual slope in all detention basins and ponds. No vertical walls. <br /> In regards to dust, the Town Chairman, Bill Hall, if after physically viewing the site, <br /> deems that dust is causing a problem, will have the right to shut the. job down. <br /> In regards to noise, the contractor will abide by the City of Madison noise ordinance. <br /> Approximately ten acres of land will be opened up for clay extraction at one Lime. <br /> When the excavation is complete on the first ten acres, the next ten acres will be <br /> stripped of topsoil. That topsoil will then be placed on the first ten acres stripped. <br /> This procern>-e will then be repeated for the following acres. After the topsoil is <br /> replaced, it will be graded and seeded. <br /> Soil erosion control measures will be required and enforced. Siltation fences will <br /> be constructed as required. <br /> It is proposed that the land be kept in grassland/hay production for an initial five <br /> year period to allow soil structure to become re-established, and to assure no harmful <br /> effects to area groundwater. After this initial period, the reintroduction of a more <br /> intense land use such as row-crop agriculture may be allowed based on soil test results <br /> and committee approval. The Village of McFarland will be notified of any requested changes <br /> in land use. <br /> Contractor will distribute safety educational material to all neighbors. <br /> Hours of operation will be 6:30 a.m. to 5:30 p.m. . We have removed clay <br /> from two other sources in 1985 (the Valiulis property and the Homburg-Droster property) . <br /> The town chairman of Cottage Grove has stated that the clay extraction from the Homburg- <br /> Droster property has caused drainage problems on Mr. Olaf Swenson's property. We have <br /> visited with Mr. Swenson and he has said that the drainage problem got bad when the <br /> highway was reworked in that area. He also said the Landfill has caused no significant <br /> problem. <br /> We have removed clay from other areas and have restored the land. We will be good <br /> neighbors on this project. Dane County Public Works has always been responsive tc <br /> citizen complaints. Our door is always open and we pledge to resolve any unanticipated <br /> problems. <br /> r <br />
