As you may
or may not be aware, a group of prehistoric burial mounds is located on
this property. Exactly how many mounds are present and where they are
located is uncertain. The historic documentation on file at the State
Historical Society is vague at best.
Wisconsin's Burial Sites Preservation Law, Section 157.70 of the
Wisconsin Statutes, provides protection for catalogued burial sites.
While the mounds on this property have not yet been catalogued, we have
received a verbal request to initiate this action.
At this time, I wanted to inform you of this matter and indicate to you
that while we do not oppose the zoning change, we do believe that
conflict with the burial law could arise if care is not taken in
developing the plot. The major problem that exists is that we do not
know exactly what is on the property and where it is located. We would
recommend that a "qualified archeologist" 157.70(1)(i) Wis. Stats.)
examine the property to accurately locate and identify burial mounds.
While it is extremely likely that prehistoric habitation sites may also
be present on the property, these have no protection under the law in
this type of project.
In a related matter, this situation is likely to occur again. It might
be worthwhile if we developed some sort of data exchange or review
mechanism whereby such zoning requests would be screened for the presence
of burial sites or other archeological historic sites. In this regard,. I
would be pleased to work with your staff to consider this matter -further.
Please contact me at (608)262-2732 if there are any questions in this
matter.
incerely,
/641A-S4j .L.461 .,
DEC 211988
nivi`i'i:.'
