DECLARATION OF RESTRICTIONS <br /> This Declaration is made this day of May, 1989, <br /> by Jiffy Stop, Inc . and Johnston Oil, Inc. ( herein after collectively <br /> referred to as "Owner" ) <br /> W I T N E S S E T H : <br /> WHEREAS, Jiffy Stop, Inc . is the owner of the real <br /> estate in the Town of Pleasant Springs, Dane County, Wisconsin, <br /> as described on Exhibit A attached hereto ; and Johnston Oil <br /> Inc. is the owner of the real estate in the Town of Pleasant <br /> Springs, Dane County, Wisconsin, as described on Exhibit B <br /> attached hereto ( the Exhibit A real estate and Exhibit B real <br /> estate hereinafter collectively referred to as the "Property" ) ; and <br /> WHEREAS, the Owner desires to place certain restrictions <br /> on the Property to bind the Owner and those who may acquire <br /> title hereafter. <br /> NOW, THEREFORE, in consideration of the mutual benefits <br /> passing to and from the Owner and those who may hereafter purchase <br /> the Property and the parties herein named as beneficiaries <br /> of these restrictions, the parties hereto agree as follows: <br /> 1 . The following restrictions are hereby imposed: <br /> Use of the Property shall be limited to the following: <br /> ( a) Service station, dispensing of oil <br /> and fuel for autos and trucks, minor repairs <br /> to motor vehicles . <br /> ( b) Restaurant. <br /> ( c ) Truckers lounge facility ( not a motel ) . <br /> (d ) Parking of trucks. <br /> ( e) Convenience store . <br /> 2 . The restrictions provided for herein shall be <br /> enforceable at law or equity against any party <br /> who has or acquires an interest in the Property <br /> by the following parties who are named as grantees, <br /> promisees and beneficiaries with enforcement <br /> rights : <br /> ( a) The County Government of Dane County, <br /> Wisconsin, provided that the Property is under <br /> the jurisdiction of a zoning ordinance of said <br />
