Box 7969 Madison, WI 53707 Bill Fleck Dane County Zoning 210 Martin Luther King Boulevard Madison, WI 53703 Dear Mr. Fleck: After reviewing all issues discussed at the Departments October 18, 1988 hearing involving September 2, 1988 blasting at the Town of Roxbury Kippley Pit we have concluded we will be taking the following action. With authority granted from Administrative Rules, Chapter 7 Explosive Materials, Section IND 7.64(5) (b), we will be requiring the pit owner, Virgil Kippley, to be responsible for informing all future operators and blaster doing work in the Kippley Pit of the following four requirements. 1 . To notify the Mine Safety Section of DILHR of the date and time of each future blast a minimum of 24 hours before blasting. A copy of all pressure testing reports must be furnished to DILHR and Louis Breunig. This practice shall be followed until further notice. 2. To conduct preblast and postblast inspections and needed pressure testing of the Louis Breunig silos before and after each blast or series of blasts conducted during any one day. This practice must be followed until further notice. 3. To seismograph all future blasts at or near the Louis Breunig farm silos. 4. A copy of the blasting log and seismograph report must be submitted to DILHR for each blast. As of this date Virgil Kippley has not been notified of the three requirements listed in this letter.
