Klein, County Supervisor - District 34 <br /> Member of Agriculture, Environment and Land Records Com. <br /> Re: Minority Opinion on Conditional Use Permit 730 <br /> (File my opinion with this CUP, please.) <br /> On March 14, 1989 the Agriculture, Environment and Land Records Committee <br /> (AELRC) issued conditional use permit (CUP) 730. In my opinion that <br /> actions was flawed for the following reasons: <br /> 1. There were no findings of fact, as required by ordinance in <br /> section 10.255 <br /> 2. There were no findings of fact specific to the six standards <br /> identified in 10.255 (2) (h) <br /> 3. There were no findings that the six standards in 10.255 (2) (h) <br /> would be met if the CUP were issued <br /> 4. Conditions imposed were not identified as relating to any of the <br /> specific standards <br /> 5. Expedited processing of this application was not justified by any <br /> existing policies <br /> 6. Dispute as to the applicant's standing as an agent of the <br /> property owner was not adequately resolved prior to the issuance <br /> of the CUP <br /> I submit that relevant facts were not considered which would have had a <br /> bearing on whether the six standards were met or whether the applicant was <br /> indeed an agent of the property owner, Ellis Nelson. <br />
