H. Raemisch was not obligated
to pay for the testing of the L. Breunig havestors this last spring.
Please be advised that DIHLR cannot release any of the conditions imposed by
Dane County. The only way the conditions can be changed or voided is to
submit an application to do so. Frank has submitted an application to change
or void some of the conditions and the request is scheduled for public hearing
on October 13, 1992. The Zoning Committee will then decide if and what
conditions will be changed.
Therefore, until changes are approved, the existing conditions on CUP 698—C
remain in effect and F. H. Raemisch & Sons is required to comply with them.
Condition #3 of the Conditional Use Permit states as follows: "Postblast
testing of the Breunig Harvestors shall be done if blasts exceed a peak
particle velocity in excess of 0.06 IPS". If the blasting last spring
exceeded the specified level F. H. Raemisch & Sons is obligated to do the
testing. If you have any questions please contact me.
Sincerely yours,
William Fleck,
Zoning Administrator
CC: L. Breunig, Badgerland Agri—Systems
