rift v <br /> i <br /> COVENANTS AND RESTRICTIONS <br /> Declaration of Conditions, Covenants, Reservations <br /> and Restrictions for Lots One (1) Through <br /> Four (4) , Certified Survey Map <br /> No. 6396, Town of Burke, County of <br /> Dane, State of Wisconsin <br /> WHEREAS, Hwy. 19 Joint Venture, a Wisconsin general <br /> partnership (hereinafter referred to as the "Developer") is the <br /> owner of the real estate ("Real Estate") described in Exhibit A <br /> attached hereto and also described as: <br /> Lots One (1) through Four (4) , Certified Survey Map No. <br /> 6396, recorded with the Dane County Register of Deeds in <br /> Volume 31, at page 94 , and located in the Town of Burke, <br /> County of Dane, State of Wisconsin; and <br /> WHEREAS, the Real Estate has been zoned C-2 Commercial <br /> District pursuant to the Dane County Code of Ordinances subject to <br /> certain restrictions on the use of the Real Estate (the "Zoning <br /> Restrictions") ; and <br /> WHEREAS, the Developer intends to subdivide the Real Estate <br /> into fourteen (14) lots and two (2) outlots (collectively, the <br /> "Lots") , which subdivision shall be known as the "Burke Highway 19 <br /> Commercial Plat" (the "Plat") ; and <br /> WHEREAS, the Developer desires to obligate owners of the Lots <br /> to be bound by certain conditions, covenants, reservations and <br /> restrictions (collectively, the "Covenants") for the benefit of all <br /> owners of the Lots; and <br /> WHEREAS, the Developer desires to hereby memorialize the <br /> Zoning Restrictions and the Covenants and cause them to be recorded <br /> with the Dane County Register of Deeds. <br /> NOW, THEREFORE, the Developer hereby declares and provides <br /> that the Real Estate is subject to the conditions, covenants, <br /> reservations and restrictions hereinafter described. <br /> 1. Zoning Restrictions. Ownership and use of the Lots, and <br /> each of them, shall be limited to the following ("Zoning <br /> Restrictions") : <br /> (a) C-1. All uses permitted in the C-1 Commercial <br /> District as of the June 3 , 1991 and as specified in Section <br /> 10. 13 of the Dane County Code of Ordinances, excepting rooming <br /> and boarding houses (Section 10. 13 (1) (g) ) ; and <br /> (b) C-2 . All uses permitted in the C-2 Commercial <br /> District as of June 3 , 1991 and as specified in Section 10. 14 <br /> of the Dane County Code of Ordinances, excepting the <br /> following: <br />
