writing by the Developer or its agent appointed for such <br /> purpose. Developer shall grant or deny Architectural Approval <br /> within thirty (30) days after receipt by Developer of the <br /> plans, specifications and drawings (including site plans, if <br /> applicable) . If the Developer fails to deny or grant <br /> Architectural Approval within said thirty- (30-) day period, <br /> the Developer shall be deemed to have given Architectural <br /> Approval. The granting of Architectural Approval by Developer <br /> shall not be construed or interpreted to mean that the plans, <br /> specifications and drawings (including site plans, if <br /> applicable) , and any construction in accordance therewith, <br /> will be in compliance with any applicable building codes, <br /> ordinances, regulations, setback requirements or any other <br /> statute, rule, regulation or law applicable thereto. The Lot <br /> owner shall be solely and exclusively responsible for <br /> determining and insuring such compliance and holds the <br /> Developer harmless with regard thereto. <br /> (d) Town of Burke Plan Commission Approval. Prior to <br /> the commencement from time to time of construction of any <br /> improvements on a Lot, and provided the owner thereof shall <br /> have received Architectural Approval from the Developer, the <br /> owner shall submit building landscaping plans, specifications <br /> and drawings (including site plans, if applicable) to the Town <br /> of Burke Plan Commission. Such plans, specifications and <br /> drawings (and site plans, if applicable) are subject to <br /> approval by the Town of Burke Plan Commission (or its <br /> successor) . <br /> (e) Other General Restrictions. The following general <br /> restrictions shall apply to the Lots: <br /> (i) not less than 12% of the vertical surface area of <br /> any building or other structure which substantially <br /> faces I90-94 , the Off-Ramp, Wisconsin Highway 19 or <br /> a public street, as the case may be, shall consist <br /> of brick, glass, stone or any combination thereof; <br /> (ii) loading docks, if any, shall be located so as to <br /> allow access thereto without the need for a vehicle <br /> to back up on a public street; <br /> (iii) all buildings and other structures to be <br /> constructed on a Lot shall be designed and <br /> constructed so as to allow sewer and water systems <br /> to be connected to public sewer and/or water; and, <br /> when public sewer and/or water is available, all <br /> buildings and other structures located on a Lot <br /> shall be hooked up thereto within 12 months after <br /> either of such utility services becomes available <br /> and any existing water and/or sewer system located <br /> on the Lot shall immediately be removed or <br /> -5- <br />
