(c) Notices. Any notice required to be sent to any <br /> owner of a Lot under these Covenants and Restrictions shall be <br /> deemed to have been given upon personal delivery thereof or <br /> upon mailing in the United States Mails, first class mail, <br /> postage prepaid, addressed to the owner as is then indicated <br /> in the public real estate tax records with regard to the Lot <br /> in question. Any notice or other documents to be provided to <br /> the Developer hereunder shall be deemed to have been given <br /> upon personal delivery thereof or upon mailing in the United <br /> States Mails, first class mail, postage prepaid, addressed as <br /> follows: <br /> Hwy. 19 Joint Venture <br /> Attention: Glenn J. Hovde <br /> 900 Shasta Drive <br /> Madison, Wisconsin 53704 <br /> (d) Binding Nature. These Covenants and Restrictions <br /> shall run with the Real Estate and shall be binding upon the <br /> owners of the Lots and their heirs, successors in interest, <br /> personal representatives, and assigns and those persons <br /> occupying or using a Lot under or through any of the <br /> foregoing. These Covenants and Restrictions shall be binding <br /> and effective for a period of 30 years from the date this <br /> document is recorded, after which period the Covenants and <br /> Restrictions shall be automatically renewed, binding and <br /> effective for successive ten- (10-) year periods, unless <br /> terminated in whole or in part by a written instrument in <br /> recordable form executed by those owners who own not fewer <br /> than ten (10) Lots. This Paragraph 3 (d) shall not apply to <br /> the Zoning Restrictions set forth in Paragraph 1, which Zoning <br /> Restrictions shall be perpetual unless and until amended or <br /> terminated in accordance with Paragraph 1. <br /> (e) Successor to Developer. At such time as the <br /> Developer no longer owns any of the Lots or has any other <br /> interest in the Lots (as a land contract vendor or mortgage <br /> holder) , the Town of Burke Plan Commission (or its successor) <br /> shall automatically succeed to the authority of the Developer <br /> under these Covenants and Restrictions. The term "Developer" , <br /> as used in these Covenants and Restrictions, shall mean Hwy. <br /> 19 Joint Venture, or its successor in interest to which the <br /> rights of the Developer hereunder have been assigned. <br /> (f) Rights to Enforce. Any person or entity owning a <br /> Lot shall have the standing and right to commence and maintain <br /> a legal action to seek damages from, or injunctive relief <br /> against (or both) , a person or entity owning or using a Lot, <br /> or improvements located thereon, in violation of these <br /> Covenants and Restrictions; and the prevailing party shall be <br /> awarded reasonable attorneys ' fees and costs. <br /> -8- <br />
