SCHLIENGER
Mr. William Fleck
Dane County Zoning Office
City-County Building
210 Monona Ave.
Madison, WI 53709
Re: Richland Center Federal Savings & Loan Association
(Kenneth Peterson) property rezoning
Dear Mr. Fleck:
I understand from Richland Center Federal Savings & Loan Association
that they are to communicate their position to you in regard to the
proposed rezoning of their Town of Mazomanie property. It is their
position that they are firmly opposed to the rezoning of the property
from its present agricultural zoning.
The property has been used for agricultural purposes for something
like eight years and there is substantial value in the continued
agricultural use of the buildings that are located on the property. Aside
from all other considerations, it seems to me that a rezoning of the
property for something other than agricultural purposes will result in
a substantial decrease in the value of the property. Assuming that this
is the result, it seems to me that it may constitute a taking of property
without just compensation. It is difficult to believe that the value
of the property will be the same both before and after the proposed
rezoning, especially considering the limited possible use of the buildings.
Although I am not exactly sure just what prompted the rezoning
petition, I would expect that it probably came from neighbors. Although
I have had some experience in these matters, I am not used to seeing
other people succeed in having their neighbor' s property rezoned. If
any type of rezoning is done, it is the position of Richland Center Federal
Savings & Loan Association that it should still be such that some
agricultural use is still permitted on the property. Although I don't
have a copy of the Dane County Zoning Ordinance before me, I think that
this might possibly be something like RH2. Again, my client is very
much opposed to any rezoning at all . Thank you for your consideration
in this matter.
RECEIVED Sincerely yours,
SEP 23 190-5 MORROW & POPE
DANE COON 1't
By.
ZONING k /( - 'C
JRP/jm James R.
