It is their <br /> position that they are firmly opposed to the rezoning of the property <br /> from its present agricultural zoning. <br /> The property has been used for agricultural purposes for something <br /> like eight years and there is substantial value in the continued <br /> agricultural use of the buildings that are located on the property. Aside <br /> from all other considerations, it seems to me that a rezoning of the <br /> property for something other than agricultural purposes will result in <br /> a substantial decrease in the value of the property. Assuming that this <br /> is the result, it seems to me that it may constitute a taking of property <br /> without just compensation. It is difficult to believe that the value <br /> of the property will be the same both before and after the proposed <br /> rezoning, especially considering the limited possible use of the buildings. <br /> Although I am not exactly sure just what prompted the rezoning <br /> petition, I would expect that it probably came from neighbors. Although <br /> I have had some experience in these matters, I am not used to seeing <br /> other people succeed in having their neighbor' s property rezoned. If <br /> any type of rezoning is done, it is the position of Richland Center Federal <br /> Savings & Loan Association that it should still be such that some <br /> agricultural use is still permitted on the property. Although I don't <br /> have a copy of the Dane County Zoning Ordinance before me, I think that <br /> this might possibly be something like RH2. Again, my client is very <br /> much opposed to any rezoning at all .
