THOMAS J. DOCTER
Attorney
5101 UNIVERSITY AVENUE
MADISON, WISCONSIN (53705)
(608) 233- 2585
July 12, 1985
The Rev. Charles Beck
St. Martin' s Church
5959 Martinsville Road
Cross Plains, Wi . 53528
Re : Rezoning Church property to conforming use.
Dear Father Peck;
At your request I have discussed a variety of options with the
Dane County Zoning Department in response to their July 5,
1985 notice of violation.
To be conforming under the existing zoning ordinance the
20 acre Church premise should be rezoned to Agriculture-2,
with a conditional use permit for religious purposes. Cur-
rently the Church is non-conforming, but "grandfathered" ,
inasmuch as A-1 zoning requires a minimum of 35 acres
If the above is accomplished then, simultaneously, the 4
acre ball diamond would be rezoned to Recreational-1 with
a conditional use permit allowing the lights and tournaments
on limited occasions.
When these two changes are made the Church property, as it is
now being used , will conform. I might add that there
have never been any registered or unvarified complaints
with the operation of the ball diamond . The zoning in-
spector happens to have participated in a softball tourn-
ament at the site recently and felt obligated to correct
an impropriety brought to his attention several years ago
when an application to rezone was withdrawn.
Ia you and 6thSeIcwi e
will be b happy py to
