•
•
',, Dane County Planning & Development
1 Division of Zoning
NOTICE OF VIOLATION-
NO SHORELAND EROSION CONTROL PERMIT
August 18, 2006
John & Holly Von Allmen—Landowners
2808 Berkan St.
Madison, WI 53711
Location: 2808 Berkan St, Town of Dunn, Section 08, Parcel#: 0610-082-6044-5
RE: NO SHORELAND EROSION CONTROL PERMIT, SITE HAS LAND DISTURBANCE
WITHIN 300 FEET OF LAKE, NEED SHORELAND EROSION CONTROL PERMIT
Dear Mr. and Mrs. Von Allmen,
This department recently visited your property on Berkan Street to do a inspection. This
inspection disclosed a violation. A new concrete slab was installed on the property, without a
valid permit in hand. Unfortunately you must now obtain an after-the-fact Shoreland Erosion
Control Permit to address the work already done and any left to be completed. The reason for
this is that your property is in the Shoreland Zone, or within 300 feet of a navigable waterway
(Lake Waubesa).
You must now obtain a Dane County Shoreland Erosion Control Permit to address the current
and future erosion control needs of the site. This permit must be designed and stamped by a
Professional Engineer. You need to obtain a new Shoreland Erosion Control permit prior to any
other work occurring, including landscaping, or for any other reason. You will also be charged
double fees because no current Erosion Control Permit is in effect.
VIOLATION: Section 11.05(3)-Permit Required: Except as provided in section 11.05(2)(a), a
shoreland erosion control permit is required for any of the following: (a)Any land
disturbing activity, of any size, any portion of which occurs in any of the following areas:
1. Within 300 feet of the ordinary high-water mark of any navigable water;
NOTICE: You or your agent must make application in person for the Shoreland Erosion
Control Permit with 2 copies of all materials, on or before August 25, 2006, by 4:00 p.m.
This permit must be designed and stamped by a Professional Engineer, and presented in
complete format, or it will be rejected.
This notice also serves as a STOP WORK ORDER-ALL WORK SHALL CEASE ON THE
PROJECT UNTIL THE SHORELAND EROSION CONTROL PERMIT HAS BEEN APPROVED
AND ISSUED.
1
210 Martin Luther King Jr.Blvd. ❖Room 116,City-County Bldg. ❖Madison,WI 53703-3342❖Phone:608.266.1591❖Fax:608.267.1540
E-mail:starks@co.dane.wi.us
