.
Town of Dunn 10/13/85
4156 CTH B
McFarland, WI 53558
Attention: Town Clerk
Subject: Zoning Petition 3548
Scott Wilson
Dear Rosalind Gausman
It has been brought to out attention that Scott Wilson has requested
the Dunn Plan Commission act on the Dane County Zoning Petition 3548
regarding RH-2 and C-1 rezoning of agricultural lands,.
My wife and I have just recently built a new home and moved to the Town
of Dunn. The Wilsons are neighbors of ours. I have talked to Scott and
his wife on sveral occasions and I have seen his small cabinet shop in
the back of his horse barn
On Tuesday, Oct 8, 1985, Scott came to our home and requested our
signitures on a petition approving the above mentioned rezoning. Since
his current cabinetmaking activities have not interfered with the quality
of life in the neighborhood and his expansion plans were modest, able
to utilize his present septic system, we signed the petition requesting
approval for the rezoning.
Subsequently, I have talked at length with our lawyer, Jack Koschalek,
and studied the zoning ordinances as they apply to commerical rezoning.
My wife and I have discussed this matter thoroughly and now think it is
prudent to withdraw out support for zoning petition 3548. While Scott
Wilson current commercial practices do not adversely effect the environ-
mental quality of life in the immediate neighborhood, neither we nor our
lawyer can see a way under current law and Town of Dunn policy to prohibit
further efforts by other land owners to request similar commerical
re-zoning. If Scott Wilson's modest request were approved, it would set
a precedent for lawsuits against the Town of Dunn if they denied any future
applications for commerical re-zoning. This difficulty points to the
need for a comprehensive zoing policy in the Town of Towno
In summary,' we are withdrawing our previous support for zoning petition
3548. We see no alternative. While we can support Scotts request based
soley on the merits of his modest needs to expand his business and the
environmental needs of the immediate neighborhood; we cannot support his
request when we consider the overall needs in the Town of Dunn to control
the willy-nilly expansion of commerical activity.and preserve the rural
qu'Ality of life.
/:
l'://1";1-6C./ ,AZ)-"L
6,X444
`-1,/ RECEIVED
Daniel & CharmianLKlyve-Wood
2822 Lalor Rd.
