If the applicant alledges that there was some minor slavaging of <br /> scrap iron or similar items as part of the landfill operation, <br /> Section 10.21 Sub (4) says: "No use which is not the principal <br /> use of the land on which it is located shall be considered a <br /> valid non-conforming use." <br /> 4. Even had it been a commercial recycling center at the time of the <br /> ordinance it would have had to have been on an extremely limited <br /> basis and Section 10.21, sub (1 ) says: "No building or premises <br /> used as a non-conforming use shall be added to or structurally <br /> altered so as to increase the facilities for such non-conforming <br /> use." <br /> It appears clear in view of the above that the non-conforming use or <br /> grandfather clause is not relevant to this request for rezoning and conditional <br /> use. <br /> In making your decision on this request for rezoning and conditional use <br /> the Zoning Committee should take into consideration the fact that the Township <br /> is the applicant. The Town is certainly not a neutral party as is usually the <br /> case and therefore the Town's recommendation for approval should be given no <br /> consideration because of their obvious conflict of interest. <br /> Our strongest objections are to the Conditional Use of the property as a <br /> commercial recycling facility; however; We object strongly to the rezoning from <br /> A-1 Exlusive to A-2 because the conditional use is not allowable in A-1 Exclusive <br /> but is a possibility in A-2. Therefore, we ask that the zoning change be denied <br /> on the basis of a possible future conditional use, which is not in keeping with <br /> the nature of the present and future residential neighborhood and traffic. <br /> Obviously the only reason for the request for zoning change is to be eligible for <br /> the conditional use. Therefore, The zoning change should be denied. <br /> In conclusion I suggest that the requested rezoning and conditional use permit <br /> for a commercial recycling facility at this location is not only impossible to <br /> approve on the basis of the County Ordinance but would be an immensely unfair, unsafe <br /> and economically devasting action to levy upon the present and future residents of <br /> this residential community. <br />
