The site did not have proper erosion control or stabilization at time of site visit. <br /> Information was provided to the Department that the area was an area of historic fill(construction debris such as <br /> broken concrete)which existed at the site prior to Mr. Anderson acquiring it. Mr.Anderson had at first covered <br /> the historic fill with topsoil, seeded, and matted it. Per the consultants advice, Mr.Anderson removed the entire <br /> historic fill pile(with a back hoe) and hauled it off site(September 23). <br /> For restoration purposes the wetland boundary was identified by the Department as the"worst-case scenario", one <br /> foot above the toe of slope. Such a line would also correspond to approximately the 10-yr flood elevation. <br /> Verification of site stabilization and erosion control was submitted to the Department on 11/5/2016. <br /> Based on this compliance review,you have resolved the alleged violations and no additional enforcement action <br /> will be taken.The Department may reconsider this decision if additional violations occur in the future. <br /> I greatly appreciate your cooperation in this matter.
