<br /> In consideration of One Dollar($1.00)and other valuable considerations,receipt of which is hereby acknowledged,the
<br /> undersigned, hereinafter called Grantor, (whether one or more) for themselves, their heirs, executors, administrators, successors and
<br /> assigns, hereby grant to MADISON GAS AND ELECTRIC COMPANY,a Wisconsin corporation,its successors and assigns,hereinafter
<br /> called Grantee, the perpetual right and easement to survey, construct, erect, maintain, inspect,operate,and replace transmission line
<br /> structures of such material as said Grantee may select, together with the necessary footings and underground and above ground
<br /> accessories in such locations as may be selected by said Grantee, and to string, operate, inspect, maintain, move, remove, replace,
<br /> locate and relocate wires, cables and related accessories and appurtenances upon, along and, across,under and through the following
<br /> described land owned by the Grantor in Dane County, State of Wisconsin:
<br /> The West 50 feet of the Ei, SW of Section 5; the West 50 feet of the Ei, NW4, and the
<br /> East 50 feet of the SW'W, NW of Section 8, all being in T7N, R8E.
<br /> •
<br /> •
<br /> TOGETHER with the right of the Grantee to enter upon the property of the Grantor described above for any of the
<br /> purposes hereinabove set forth; to remove from the easement strip any structure, tree or object, including the branches of trees
<br /> overhanging into said easement strip,which in the opinion of the Grantee might interfere with or endanger said transmission line;and,
<br /> 'o in addition, to cut down and remove or trim such trees now or hereafter existing en the premises of the undersigned,located outside
<br /> of the easement strip which by falling,in the opinion or the Grantee,will interfere or endanger said electric line.
<br /> The Grantee shall pay grantor for all damages to crops,fences,livestock,roads and fields caused by the construction or
<br /> maintenance of said transmission line; said damages, if not mutually agreed upon, to be ascertained and determined by three
<br /> disinterested persons,one thereof to be appointed by the said Grantor,one by the said Grantee,and the third by the two so appointed
<br /> as aforesaid, and the award of any two such persons shall be final and conclusive and no action shall be brought or maintained for
<br /> damages until the amount thereof shall have been determined as above provided.
<br /> The Grantee shall not have the right to erect any fence or buildings on such land other than said line structures and
<br /> wires and the necessary facilities to protect the same against damage by trespass or otherwise.
<br /> The Grantor reserves the right to cultivate,use and occupy said land except that,without the prior written approval of
<br /> the Grantee,he shall not erect any structures,hay or straw stacks or other objects permanent or temporary,or plant any trees,within
<br /> or overhanging such right of way, and the Grantor agrees that he will not perform any act which will interfere with or endanger
<br /> said transmission line or the use thereof, or create any hazard to the Grantee or any other person. It is understood that the person
<br /> securing this grant is without authority to make any agreement in respect to the subject matter hereof not herein expressed.
<br /> This Agreement is binding upon heirs,administrators,executors,and assigns of Grantor.
