Box 1231 <br /> Madison, Wisconsin 53701-1231 <br /> 608-252-7000 <br /> mGOe® <br /> January 14, 1986 <br /> Dane County Zoning Department <br /> Room 116, City-County Building <br /> Madison, Wisconsin 53701 <br /> Gentlemen: <br /> Subject: Zoning Petition #3595 - C.U.P. #477 <br /> Madison Gas and Electric Company (MGE) has reviewed <br /> Mr. John DeBeck' s request for a zoning change on his proper- <br /> ty in the SW-4 of the NW-4 of Section 8, T7N-R8E, town of <br /> Middleton, Dane County, Wisconsin. <br /> We have no objection to the zoning change from A-1 Agricul- <br /> ture District to A-2 Agriculture District as long as our <br /> easement is unaffected. However, we do object to a mineral <br /> extraction/quarry in the northeasterly 10 acres of the <br /> property. <br /> MGE has a 138-kV overhead transmission line located along <br /> the east line of the SW-4 of the NW-; of Section 8. The <br /> line was installed by rights obtained through an electric <br /> line easement, copy enclosed, executed by the owners, <br /> Elmer J. Jungbluth and Laveta Jungbluth on June 11, 1970. <br /> The easement consists of a strip of land 50 feet in width <br /> along the easterly side of the SW of the NW-4 of <br /> Section 8. <br /> Dynamite blast rock quarrying in close proximity to the <br /> transmission line presents serious problems in respect to <br /> the line being damaged by rock particles and we also object <br /> to the removal of material necessary to support the pole <br /> structures. <br /> MGE, with this letter, is notifying and reminding the Dane <br /> County Zoning Department and Mr. John DeBeck of our ease- <br /> ment which reads, "that no act will be performed that will <br /> interfere with or endanger said transmission line or the <br /> use thereof, or create any hazard to the grantee (MGE) or <br /> any other person.
