Shared Private Driveway Access Easement Agreement

<br /> Grantors: Phillip&Delores Esser(Esser Living Trust)
<br /> Grantees: Solomon Partners LLC, David J.Morley and Carole L.Morley Members
<br /> Whereas the Grantees have a Purchase Agreement dated January 7,2007,to purchase the
<br /> property particularly described as:
<br /> Lot#1 and Lot#2 on CSM 11967,Vol. 73,Page 274 on Documents 4249419,on Erb
<br /> Rd.,Town of Springdale,County of Dane, State of Wisconsin.
<br /> Whereas a condition of the Purchase Agreement is that the Grantors will provide the
<br /> Grantees and Grantees successors a Shared Private Driveway Access Easement
<br /> Agreement upon the purchase of the above described property.
<br /> Whereas Grantor is willing to grant an easement 66 feet wide running along the northern most
<br /> property line of Lot#3 (on CSM 11967,Vol. 73,Page 274 on Documents 4249419,on Erb Rd.,
<br /> Town of Springdale,County of Dane, State of Wisconsin)for a distance of 869 feet. The
<br /> purpose of this easement is for access to Lot#1 and Lot#2 using a Shared Private Driveway.
<br /> NOW THEREFORE,and in consideration of the sum of$1.00 and other good and valuable
<br /> consideration,receipt of which is hereby acknowledged, Grantors convey to Grantees,their
<br /> successors,heirs and assigns a permanent shared driveway easement over,across and through
<br /> the above described 66 feet by 869 feet for the purpose of planting,maintaining,and replacing
<br /> landscaping plants,trees, flowers, scrubs,grasses, fencing, and other landscaping materials in
<br /> addition to the construction and maintenance of a shared private driveway. Grantees and/or
<br /> Grantees assigns shall be responsible for all repair and maintenance of the easement property and
<br /> any costs incurred to maintain,repair, and construct the shared private driveway according to
<br /> Town,County,and State standards or requirements. Costs incurred to maintain,repair and
<br /> construct the private shared drive shall be paid for in accordance with the terms of the
<br /> Maintenance Plan for Shared Private Driveways Lots 1,2 and 3 as shown on CSM 11967,Vol
<br /> 73,Page 275, Town of Springdale,Dane County, WI,Erb Rd. January 7,2007
<br /> Grantees shall have access to the easement solely for the purposes described above.
