It is apparent that there has been some confusion or miss <br /> communication concerning the dimensional limits for the deck as covered under the zoning permit that was issued <br /> on October 24,2009. <br /> Zoning Permit 2008-0828 was issued for an 11.7' x 4' extension onto the existing deck at the rear of the house. <br /> The site plan showed an at-grade patio extending past the elevated deck. Upon inspection, it was found that the <br /> deck was constructed past the permitted construction following the outline of the at-grade patio as shown on the <br /> site plan. <br /> During our conversation, I was made aware that the deck was constructed in this fashion to allow your husband to <br /> access the garage. It was also revealed that your husband is suffering from a debilitating disease. Given this <br /> information,the zoning ordinance allows certain waivers of setback requirements to allow for reasonable <br /> accommodations for persons with disabled conditions by the Zoning Administrator. <br /> This letter serves as notice that a waiver has been granted to allow the rear deck to encroach upon the 38'0" <br /> setback requirement for the deck in the rear yard. The deck may be allowed to be constructed to the garage for <br /> the purposed of providing access for a disabled person. Please keep in mind that if and when your husband <br /> vacates the premises,the portion of the deck that is encroaching in the 38'-0" setback will be required to be <br /> removed. A deed notice may be placed on the property to this effect to assure compliance. <br /> I understand that reconstructing the deck to comply with the 38'-0"setback would be a cost incurred by you, but <br /> in the long run, it would be best to correct the issue before the deck is completed. <br /> Your cooperation is appreciated.
