Request to extend one-year deadline for obtaining Zoning Permit allowed under Variance Appeal <br /> 3428, as granted at the June 26, 2006 Public Hearing and July 27, 2006 Board meeting, to allow <br /> construction of new single-family residence to replace home damaged more than 50 percent by <br /> June flooding of Lake Koshkonong: <br /> Appeal 3428 by Eugeny& Olga Matusevich for variances from minimum required lot width and lot area <br /> in the Shoreland district as provided by Sections 11.03(1) and 10.05(4), and minimum required extent of <br /> fill beyond limits of structure in the Floodfringe district as provided by Section 17.39(1)(a), Dane County <br /> Code of Ordinances, to permit new one-lot Certified Survey Map and construction of new single-family <br /> residence as proposed at 362 Lakeshore Drive being Lot 14 and north half Lot 13, Block 1, Edgerton <br /> Beach Park, Section 25, Town of Albion. <br /> COMMUNICATIONS: None <br /> VARIANCES REQUESTED: See Finding of Fact, below. <br /> IN FAVOR: None (The owners requested to be excused from appearing in person before the Board.) <br /> OPPOSED: None <br /> Motion: Reynolds/Long to grant an extension of the one-year period in which to obtain a Zoning <br /> Permit for the improvements allowed under Variance Appeal 3428, as granted on June 26 and July <br /> 27, 2006 for a proposed new single-family residence. <br /> Staff Note: The plans and elevation submitted in June 2006 must be used for the new Zoning Permit, <br /> which must be obtained no later than September 25, 2009. A Floodplain Filling Permit and Shoreland <br /> Erosion Control Permit are also required. <br /> Finding of Fact: <br /> A. The owners did not obtain a Zoning Permit for the proposed new home permitted under Appeal <br /> 3428 within one year, as required by Section 10.26(10) Dane County Code of Ordinances <br /> (DCCO). The June 2008 flooding of Lake Koshkonong severely damaged the existing home <br /> (substantial damage more than 50%). The owners now wish to demolish the damaged home and <br /> build the new home according to the plans submitted for Variance 3428. They would begin <br /> construction as soon as possible, in accordance with current Shoreland, Floodzone and Zoning <br /> Ordinances. Note: Eugene, Olga and Tomas Matusevitch are co-owners of Ameris LLC, the <br /> current property owner of record for this appeal. <br /> B. Variances requested and actions of the Board at the 06/26/2006 Public Hearing (paraphrased): <br /> Owners proposed building a new house in compliance with all Zoning, Shoreland and Floodplain <br /> requirements of the DCCO to replace an existing non-conforming house. They were granted <br /> variances of: <br /> o 32.5 feet from minimum 100 feet required lot width at the building setback line in the <br /> Shoreland district (existing lot width 67.5+-feet). <br /> o 4,003 square feet (SF) from 15,000 SF required minimum lot area in the Shoreland district <br /> (existing 10,997+- SF lot area). <br /> o 5+-feet on north and south sides of house from minimum required 15 feet of fill beyond limits <br /> of structure in Flood Fringe district with Condition: That the fill on all sides of the house must <br /> be compacted and installation must meet all American Society of Civil Engineers (ASCE) <br /> standards <br /> Motion carried to extend deadline for Appeal 3428 for one year: 4—0 on a roll call vote.
