DANE COUNTY ORDINANCE AMENDMENT NO. 9397 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Perry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of <br /> Perry be amended to include in the RH-1 Rural Homes and A-2 Agricultural District/s the following described <br /> land: <br /> PETITION NUMBER: 9397 <br /> TO RH-1: <br /> Part of the NW 1/4 NE 1/4 of Section 12, Town of Perry described as follows: Commencing at the North quarter <br /> corner of Section 12; thence South 420 feet; thence East 180 feet to the point of beginning; thence East 400 feet; <br /> thence North 250 feet; thence West 300 feet; thence S45° West 141.4 feet; thence South 150 feet to the point of <br /> beginning. <br /> TO A-2: <br /> Part of the NE 1/4 NW 1/4, and part of the NW 1/4 NE 1/4, all in Section 12, Town of Perry described as follows: <br /> Beginning at the North quarter corner of Section 12; thence South 420 feet; thence East 180 feet; thence East 400 <br /> feet; thence North 250 feet; thence West 300 feet; thence S45° West 141.4 feet; thence South 150 feet; thence West <br /> 180 feet; thence North 420 feet; thence East to the Northeast corner of the said NW 1/4 of the NE 1/4; thence South <br /> along the East line of the said NW 1/4 NE 1/4, to the centerline of East Perry Center Road; thence Southwesterly <br /> along said centerline to the centerline of Keller Road; thence North along said centerline to the North line of the NE <br /> 1/4 NW 1/4; thence East to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following condition(s). <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective if within 90 days of its adoption by Dane County the owner or owners of the <br /> land record the following restriction(s) on said land: <br /> 1) Deed restrict the A-2 lot prohibiting residential development(parcels 0506-121-8501 and 0506-121-8001). <br /> Said restriction(s) shall run in favor of Dane County and the pertinent Town Board(s) as well as the owners of <br /> land within 300 feet of the site. Failure to record the restriction(s) will cause the rezone to be null and <br /> void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> EFFECTIVE: 3 /.-s-r <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the <br /> provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
