Applicant has contacted an engineering firm and work not yet completed. <br /> 2) . Work is in conjunction with landscaping after new home construction. <br /> 3) . No neighbor objection was received. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. Motion <br /> carried - 3-0. <br /> #1927. Harvey/Jones to grant, with condition, variance of 30 more or less <br /> feet from required setback to USH 51 right-of-way to permit construction of <br /> fuel storage tanks and accessory building. <br /> CONDITIONS: <br /> 1) . The structures shall be removed at the owners expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . New state laws require fuel storage be strictly regulated. <br /> 2) . Existing L.P. tanks are already further into setback. <br /> 3) . Traffic patterns and storage areas limit available site. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public interest. <br /> Motion carried - 3-0. <br /> #1928. Highway Department has expanded right-of-way and anticipates no further <br /> right-of-ways will be needed. <br /> 2) .
