As you are aware, the single family
residence, which is located at 390 Lake Shore Dr, is within the 100-year floodplain as noted on Flood Insurance
Rate Map (FIRM) Number 55025C0850F, effective June 17, 2003, and is considered a non-conforming structure.
A site inspection was conducted on your property on July 17, 2008. It was observed that the floodwaters from the
last storm event significantly damaged your single family residence. It was observed that the floodwaters reached
approximately 2'-6"feet above the first floor elevation and substantially damaged the residence in excess of
50% of the assessed value. See attached assessment information.
Under Dane County Code of Ordinances Section 17.11(1)(b), non-conforming structures within the 100-year
floodplain which are destroyed in excess of 50% of their assessed value cannot be repaired, reconstructed, or
rebuilt, unless the structure is brought into full compliance with the Floodplain regulations as found under Dane
County Code of Ordinances (DCCO), Chapter 17 - Floodplain Zoning.
Since the non-conforming structure was damaged in excess of 50%of the assessed value, you are hereby
instructed to bring the entire structure into compliance with regulations for structures located within the flood fringe
area as noted under Section 17.09(3), DCCO --see attached. If you choose not to rebuild, the structure will be
required to be razed (removed)within one (1)year of the date of this letter.
Please contact the Zoning Division at(608) 266-4266 to discuss your intentions for the future of this structure so
that we can assist you with the necessary requirements and permits needed to be in compliance with Dane County
Ordinances and Floodplain regulations.
Your cooperation is appreciated in this matter.
Respectfully,
Zoning Inspector
608.266.4374
schroeckenthaler @co.dane.wi.us
By Roger Lane
Dane County Zoning Administrator
