AND DOROTHY H. BAIER, hereinaf- <br /> ter referred to as "BAIERS"; and <br /> WHEREAS, the CITY is the owner of the Southeast 1/4 of the Northeast 1/4 <br /> of Section 27, Town 8 North, Range 9 East, Town of Westport, Dane County, <br /> Wisconsin, excepting a one acre parcel of land owned by BAIERS, described as <br /> follows: <br /> Part of the Southeast 1/4 of the Northeast 1/4 of Section 27, Town <br /> 8 North, Range 9 East, Town of Westport, Dane County, Wisconsin, <br /> more fully described as follows: <br /> Beginning at a point that is 230 feet West of, measured at right <br /> angles to, the East line of the Northeast 1/4 of said Section 27 <br /> and 120 feet North of, measured at right angles to, the South line <br /> of the said Northeast 1/4; thence Southwesterly 218 feet along a <br /> straight line to a point; last mentioned point being 440 feet West <br /> of, measured at right angles to, the East line of the said North- <br /> east 1/4 and 25 feet North of, measured at right angles to, the <br /> South line of the said Northeast 1/4; thence Northwesterly 200 <br /> feet along a straight line which is at right angles to the last <br /> described course; thence Northeasterly 218 feet along a straight <br /> line which lies at right angles to the last described course; <br /> thence Southeasterly 200 feet along a straight line which lies at <br /> right angles to the last described course to the point of begin- <br /> ning. Said parcel being identified as "Baler" property on the <br /> Attached Exhibit "A" and made part of this Agreement. <br /> and; <br /> WHEREAS, a portion of the driveway presently serving the BAIERS property <br /> is located on City-owned lands in the said Northeast 1/4; and <br /> WHEREAS, the CITY and BAIERS are desirous of retaining the driveway in <br /> its present location; and <br /> WHEREAS, the CITY is desirous of having the option to realign the BAIERS <br /> driveway across City-owned lands to connect to Knutson Drive as proposed in <br /> the Plat of Westport Meadows. <br /> NOW, THEREFORE, in consideration of the foregoing, the parties hereby <br /> agree as follows: <br /> 1. The CITY hereby conveys and grants unto the BAIERS a Private Driveway <br /> Easement 30 feet in width, the centerline of which is shown and located on the <br /> attached Exhibit "A" and is more fully described as follows: <br /> Beginning at a point in the South line of the Northeast 1/4 of <br /> Section 27, Township 8 North, Range 9 East, Town of Westport, Dane <br /> County, Wisconsin, said point being 15 feet Southwest of, measured <br /> at right angles to, the Northeast line of the Southwest 1/2 of the <br /> Southeast 1/4 of the said Northeast 1/4; thence Northwesterly on a <br /> line that is parallel to and 15 feet Southwest of, measured at <br /> right angles to, the Northeast line of the Southwest 1/2 of the <br /> Southeast 1/4 of the Northeast 1/4 of said Section 27, 140 feet; <br /> thence on a curve to the left, convex to the North, having a <br /> radius of 165 feet, to a point in the Northeast line of the Baier <br /> property as described above, said point being 30 feet Northwest of <br /> the most Easterly corner of the Baier property, measured along the <br /> Northeast line of the said Baler property as described above. <br /> Last mentioned point being the end of the described centerline. <br /> 2.
