The City of Madison <br /> purchased 19 acres (proposed lot 1) on March 15, 1985, for inclusion <br /> in the Cherokee Marsh Conservation Park. The Baiers proposed this <br /> sale due to the financial hardship caused by Mr. Baier's retirement <br /> and partial disability. The City purchase allowed the Baiers to <br /> retain their house on one acre (proposed lot 2) . At that time, <br /> it was mistakenly assumed that a lot division was not necessary <br /> because the sale was vacant land to an adjacent landowner (the City <br /> owns all the land surrounding the 20 acres) . <br /> The Baier acquisition is part of the City's continuing effort <br /> since the 1960's to preserve the valuable wetlands and open space <br /> of Cherokee Marsh. Madison, the Town of Westport, Dane County, <br /> and other agencies adopted a long-range open space plan for Cherokee <br /> Marsh in 1981. Part of that plan, and a high priority for City <br /> activity, was acquisition of the designated open space north of <br /> the Mendota Hospital property. The City purchased the Cox property <br /> in 1982 and the Voss property in 1983. During that time, the Town <br /> of Westport also obtained deed restrictions protecting the wetlands <br /> on the Hanson property. In 1985, the City acquired the Baier property- <br /> --the last parcel in a large block of protected wetland and wooded <br /> edge. <br /> The principal objection to the proposed division of the Baier <br /> property is that it does not meet the standards for public street <br /> frontage. This causes some difficulty because the only public street <br /> access for the entire 20 acres is 33 feet at the end of Loeprich <br /> Lane, an unimproved City street.
