Agriculture to RH-1 Rural Homes - Section <br /> 32, Town of Rutland. <br /> Dear Mr. Schwartzlow: <br /> Please be advised that all required approvals by Town, Zoning Committee, Dane <br /> County Board and County Executive have been obtained. <br /> The petition included a delayed effective date subject to the recording of a <br /> certified survey. The survey must be recorded no later than August 8, 1986. <br /> Failure to record the survey will null and void the zoning. <br /> The Town Board's approval was with the condition that there be only one lot of <br /> not more than 2 acres in area. A 2 lot survey currently exists which includes <br /> the land in question, this survey must be modified or corrected in order to <br /> comply with the conditions specified by the Town Board. There was some <br /> discussion of recording a quit-claim deed to yourself or the estate to add the <br /> second lot, to your larger holdings and as a result eliminate it. A <br /> quit-claim deed to self will not convey an interest in land and cannot be used <br /> for that purpose according to our attorneys. It is my understanding that a <br /> corrective survey document can be commissioned and recorded to accomplish what <br /> is necessary. <br /> Please contact your surveyor and Norbert Scribner the Dane County Plat/Survey <br /> Review Officer (608 - 266-9086) for the correct procedure.
