Hegge
5880 county Highway TT
Marshall WI 53559
Dear Richard L. Hegge:
As per Dane County Zoning Administrator, Mr. James E. Gregorius, contract zoning is
illegal in the state of Wisconsin.
The conditions for approval by the Town of Medina that you showed me and that I
related to the Dane County Zoning Administrator constitute contract zoning.
The were no conditions shown by the Town of Medina for-the approval of the zoning
change in question, #3665. A copy of form #545-75 (7/84) T. B. Action is enclosed with
notations I have made, initials RB.
A copy of the newspaper notice for the public hearing is enclosed along with six(6) other
related documents that you may or may not already have in your possession.
The Dane County Board of Supervisors approved the zoning change to R-3 Residential
as shown in the copy of the Dane County Board minutes that you were given yesterday
by the Deputy Dane County Clerk.
I provided Mr. Norbert Scribner, the Dane County Land Division Review Officer, your
name, your address, your telephone number, and your request for any specific
information as I promised you I would. He responds in writing to written inquiries
addressed to him.
There were no audio tapes ever made for the meeting of 5/27/86. There were audio
cassette tapes made for the public hearing of 5/13/86, but those tapes have long since
deteriorated in quality and have been destroyed. Mr. Joseph T. Parisi, the Dane County
Clerk, may be able to provide you with audio tapes of the County Board meeting of
6/5/86. and anyconcerning the meetings in question.
Inconsistencies exist in the Dane County Zoning office records as you have correctly
noted. The "NOTICE OF PUBLIC HEARING" document reads "... to change the zoning
from RH-2 Rural Homes to R-1 Residential ...°. The 545-84(6/83) RE-ZONE APP'L
PREP. form shows the "R-1"was changed to "R-3"with white-out. Form 545-21(11/79)
shows "... to the R-3 Residential District. ...". The "NOTICE OF PUBLIC HEARING
document with the map states "... to the R-3 Residential District. ...". The enclosed form
