Horseshoe Pits/2/24/87 <br /> Page 2 <br /> Amusement places were permitted in the B-i Local Business District from 1950 to 1976 <br /> when the Ordinance was amended to require C-1 or C-2 Zoning with a Conditional Use <br /> Permit for "outdoor amusement parks or other entertainment activity whether on a <br /> permanent or temporary basis that is open to the general public." <br /> 1980: - Zoning Ordinance amended to allow recreational facilities as a permitted use in <br /> the RE-1 District. <br /> Section 10.10 (1) (a) - provided that recreational facilities included but were not <br /> limited to golf courses, golf driving ranges, tennis courts, archery ranges, and <br /> baseball diamonds, provided that if located outside of a building they shall not be <br /> lighted to operate during the hours of darkness. Conditional Use Permit required for <br /> lighted night operation. Because of the phraseology "not limited to" horseshoe pits as <br /> a recreational facility could be permitted in the RE-1 Recreational District but, this <br /> would require taverns to rezone a portion of their property to RE-1. <br /> 1984: - Town of Westport had a couple of taverns that were or wished to provide <br /> recreational games such as horseshoes, volley ball etc. for their customers. They did <br /> not wish to rezone to RE-1 Recreational because of the loss of B-1 Local Business <br /> District Zoning area. The Town Board requested through Jim Tierney, County Board <br /> Supervisor and Town Board member at the time, an amendment to the Zoning Ordinance that <br /> would accommodate the taverns. The town recommended that lighted night operation be <br /> maintained as a Conditional Use Permit consistant with provisions for other uses. <br /> 1984 May: - Jim Tierney sponsered the amendment which accommodated taverns by permitting <br /> games such as horseshoes, volleyball or similar activities not lighted for night <br /> operation, Conditional Use Permit required for lighted night operation, in B-1, C-1 and <br /> C-2 Districts. <br />
