A.E.L.R./Minutes/7/22/86
Page 4
17. CONDITIONAL USE PERMIT #504 Carl Ketelboeter to allow expansion of
residential use on property located at 8697 STH 19 in part of the NW 1/4 NW
1/4 - Section 10, Town of Berry.
PETITION #3714 by Greg Wolff, agent for Ellward Wolff to change the zoning
from A-1 Ex. Agriculture to RH-1 Rural Homes no property located at 319 East
CTH D in part of the NE 1/4 NE 1/4 - Section 35, Town of Montrose.
Hanna/Anderson approve; motion carried - 5-0
CONDITIONAL USE PERMIT #505 by Vito Gervasi to allow a single family residence
on property located at 2611 W. Beltline Highway in part of the SW 1/4 SW 1/4 -
Section 34, Town of Madison.
Hanna/Dahlk find that standards are met and issue permit; motion carried. 5-0.
CONDITIONAL USE PERMIT #506 by David Weiman to allow private airstrip on
property located at 6031 Lawry Court in part of the SE 1/4 NE 1/4 - Section
17, Town of Oregon. Rendall/Dahlk and Licht deny the conditional use permit;
FINDING OF FACT:
1) . Landing strip abuts residential lots. Landing from or take-off to the
East would be over 3 existing residences. Landing strip usage, especially if
unlimited as requested, would adversely affect normal enjoyment of adjoining
properties due to noise and concern about low flying planes. Property values
could be diminished. There are 12 residential properties within 1,000 feet of
the proposed strip.
2) . Unimproved, grass landing strip is not level and is short, approximately
900 feet. Elements of weather, temperature, humidity will affect
landing/take-off capability and decision will be subject only to the pilot's
judgement.
3) . Mechanical failure of plane/s or physical failure of pilots eg: heart
attack, could result in damage to property or loss of life.
CONCLUSION:
The following standards are not met:
1) . That the establishment, maintenance, or operation of the conditional use
will not be detrimental to or endanger the public health, safety, comfort, or
general welfare.
2). That the uses, values and enjoyment of other property in the neighborhood
for purposes already permitted shall be in no foreseeable manner substantially
impaired or diminished by establishment, maintenance or operation of the
conditional use.
Motion carried - 6-0.
PETITION #3715/CONDITIONAL USE PERMIT #507 by Edward Normandeau to change the
zoning from R-3 Residential to C-i Commercial and also allow existing single
family residence and dog grooming business on the same parcel located at 4116
Bruns Avenue in SW 1/4 NE 1/4 - Section 4, Town of Blooming Grove.
Dahlk/Hanna hold in abeyance at requests of applicant and County Supervisor
Femrite; motion carried. 6-0.
