On June 12, 1986, Mr. and Mrs. Porter were notified by <br /> mail that the Town Board of the Town of Burke intended to levy a special <br /> assessment on the property owned by the Porters in the amount of $45,000.00, to <br /> help pay for the proposed Legler Waterway Project. Subsequently, the Project <br /> was discussed during several Town meetings. The Porters objected to the <br /> assessment, stating that they were given inadequate notice of the Project and <br /> its associated costs, that their property will not be benefited by the Legler <br /> Waterway Project, that the method used for arriving at the assessment figures <br /> was arbitrary, and that the Town of Burke failed to establish that the Project <br /> was necessary and its associated costs are reasonable. The Porters reduced <br /> these objections to writing and filed them with the members of the Town Board, <br /> the Town attorney, and the Town engineer. At the same time, they filed an <br /> Application with your Department to have their property down-zoned from C-2 to <br /> A-1. The Application has been scheduled for a public hearing on August 12, <br /> 1986, at 7:30 p.m. <br /> This morning, Mr. Frank Bucaida, the Town's attorney, informed me that the <br /> Town of Burke was re-thinking its proposed tax assessment. Consequently, the <br /> Porters hereby request that their Application, No. 3728, not be discussed at the <br /> August 12 public hearing, but rather at a date some time in the future. This <br /> will provide the Porters with an opportunity to further discuss the matter with <br /> Attorney Bucaida. <br /> Thank you for your assistance in this matter.
