Subsequently, the <br /> project was discussed during several Town meetings. The Porters objected <br /> to the assessment, stating that they were given inadequate notice of the <br /> project and its associated costs, that their property would not be bene- <br /> fited by the Legler waterway project, that the method used for arriving <br /> at the assessment figures was arbitrary, and that the Town of Burke failed <br /> to establish that the project was necessary and its associated costs were <br /> reasonable. <br /> The Porters reduced these objections to writing and filed them with the <br /> members of the Town Board, the Town attorney, and the Town engineer. At <br /> the same time, they filed an application with your department to have <br /> their property down-zoned from C-2 to A-1. The application was brought <br /> on for a public hearing on August 12, 1986 at 7:30 P.M. <br /> At the hearing, I appeared on the Porters' behalf and requested that their <br /> petition be abeyed indefinitely, because the Town of Burke was re-thinking <br /> its proposed tax assessment.
