Except therefrom all lands located in <br /> U.S. Highway 151 right of way. <br /> Except those parts conveyed in Award of Damages recorded in Vol. <br /> 60 of Records, page 262, No. 1225086; and <br /> WHEREAS it is deemed proper to impose upon the above described <br /> lands certain restrictions, reservations, limitations and covenants <br /> as hereinafter set forth, for the benefit and protection of the owners, <br /> present and future, of said lands, whether they are retained intact <br /> or subsequently subdivided; <br /> NOW, THEREFORE, IT IS HEREBY DECLARED AND AGREED, that the fol- <br /> lowing restrictions, reservations, limitations and covenants be and <br /> the same hereby are adopted, and that the lands above described shall <br /> be subject thereto, as follows, to-wit: <br /> ARTICLE I <br /> These restrictive covenants are to run with the lands hereinbefore <br /> described and shall be binding upon all parties and all persons claim- <br /> ing under said owner until August 1 , 2016, at which time said covenants <br /> shall automatically be extended for succdssive periods of ten (10) <br /> years, unless by vote of a majority of the then owners of all of the <br /> above described lands it is agreed to modify said covenants in whole <br /> or in part. <br /> ARTICLE II <br /> Subject to the provisions contained in this instrument and herein- <br /> after set forth, the lands described above, or any part thereof, shall <br /> be known and described as agricultural lands EXCEPT those portions <br /> thereof which have heretofor been zoned or in the future may be rezoned <br /> for commercial purposes, which commercial purposes may be permitted <br /> after obtaining the appropriate zoning therefor from the municipal <br /> authority having zoning jurisdiction over said lands, which commercial <br /> uses that shall be permitted upon said lands, either with or without <br /> an application for a conditional use permit, shall be those uses which <br /> are allowed under Sec. 10.14 C-2 Commercial District as provided in <br /> the present zoning ordinance of the County of Dane, EXCEPT that under <br /> no circumstances shall any of the following uses be permitted or al- <br /> lowed to exist upon any portion of the above described lands, namely: <br /> A. Fertilizer mixing or blending plants; <br /> B. Slaughter houses, meat processing plants; <br /> C. Automobile racetracks, motorcycle racetracks, including moto- <br /> cross and hill climbing courses; and <br />
