the Town will be entitled to seek such equitable or other relief <br /> as it may deem appropriate. <br /> 18. Conditional Use: The terms of this agreement shall be incorpo- <br /> rated upon the granting of a conditional use by Dane County <br /> under the zoning for the Town of Vienna. <br /> 19. Successors in Interest: The terms of this agreement shall be <br /> binding upon the successors and assigns of the Operator during <br /> the terms of this agreement. <br /> 20. Assignment, Transfer, Sale: During the term of this agreement <br /> the applicant shall not transfer, sell, lease or otherwise con- <br /> vey the property upon which the mineral extraction site is to <br /> be located to any other person, entity or corporation, nor shall <br /> P & D assign or transfer this agreement to any other person, <br /> entity, or corporation, without the express approval by resolu- <br /> tion duly adopted by the Town of Vienna. Such approval shall <br /> not be unreasonably withheld. <br /> 21. Compliance with Applicable Laws: P & D will comply, at all times <br /> with the provisions of applicable state and federal statutes <br /> and regulations, and the provisions of applicable local ordinances. <br /> 22. Waiver: No waiver of any breach of this agreement shall be held <br /> to be a waiver of any other or subsequent breach. The failure <br /> of the Town to enforce at any time any of the provisions of this <br /> agreement, or to excercise any option which is herein provided, <br /> or to require at any time performance by P & D of the provisions <br /> heretof, shall be in no way construed to be a waiver of such <br /> provisions, nor in any way effect the validity of this agreement <br /> or any part thereof, or the right of the Town to thereafter en., <br /> force each and every such prevision. <br />
