Aecir <br /> h to BOARD OF SUPERVISORS <br /> i(ol„. \1� <br /> VOvrdil ls��/ COURT HOUSE - MADISON, WISCONSIN 53709 <br /> April 3, 1978 k. . <br /> Information on Exclusive Agricultural District Zoning Petition <br /> On April 11, 1978 , the Zoning Committee will have Petition #2057 <br /> up for public hearing. This petition creates a second agricul- <br /> tural district for the County Zoning Ordinance which would be in <br /> compliance with the State requirements for the Farmland Preserva- <br /> tion Tax Program. This program has been changed by action of <br /> the Legislature in the Mini-budget session and awaits the sig- <br /> nature of the Governor. These changes include excluding the <br /> first $7500 of non-farm income, deleting the section which <br /> required the property tax to be added back into income before <br /> figuring tax benefits , increasing the eligibility for tax credits <br /> from $4000 to $6000 , increasing the maximum cutoff income to $38,000 <br /> and other changes which increase the amount of credit available. <br /> Another change reduces the rollback period from 20 years to 10 years . <br /> Because of these changes plus the mapping work going on in towns , <br /> it seemed wise to make this zoning category available for those <br /> towns who wish to adopt it as soon as possible. <br /> The Zoning amendment process in this matter is a little different <br /> than others have been. Wisconsin Chapter 91.73(4) provides that <br /> "Amendments to the texts of existing county zoning ordinances to <br /> bring the ordinances into compliance with this chapter, which are <br /> adopted by the county board, shall be effective in any town which <br /> does not file a certified copy of a resolution disapproving of <br /> the amendment pursuant to s . 59.97(5) (e) 3m or 6. In those towns <br /> which disapprove of the amendment the former agricultural zoning <br /> remains in effect and shall be so designated on the official <br /> zoning map. " In other words , we would have two A-1 Districts -- <br /> one the present multi-purpose one and one exclusively agricultural. <br /> Those towns who wish to adopt the latter may do so , and those <br /> who do not may veto it. The second district would remain in the <br /> ordinance so that when a town finished its mapping process and <br /> wished to adopt it, it could do so by rescinding its veto . <br /> The changes made if the new A-1 is accepted by a town would <br /> include having farmers able to get the maximum benefits from <br /> the tax program with a simpler process to do so. The town <br /> mapping process would identify non-agricultural lands . These <br /> could be brought in for rezoning for residential or other pur- <br /> poses . (The ordinance change of last month plugged the town <br /> planning process into the County zoning process . ) Existing <br /> A-1 lots will not be affected unless a new use is proposed. <br /> The process in short for the amendment is : <br /> 1. Public hearing - April 11 at 7: 30 , City County Bldg. <br /> 2 . County Board action with other zoning petitions . <br /> 3. If passed by Board, action by County Executive. <br /> 4. If passed by Board and Executive, ordinance will -have <br /> two A-1 districts . <br /> 5 .
